39. A person shall remain on a qualifications list for a competition only until his first appointment to a position.
Notwithstanding the first paragraph, a person who has not obtained permanent employee status and who is dismissed or laid off for lack of work or because a person placed on reserve has been assigned or transferred to the position, remains on the qualifications list from which he was appointed. The person is eligible for a new appointment from the list as long as it is valid.
